Privacy Policy together with the Terms of Use and the Cookie Policy of Rako Law Office (hereinafter: Law Office) constitutes Contract which refers to users.

Privacy Policy refers to the persons which access the Website of Rako Law Office on web address  www.rakolaw.com (hereinafter: Website), address us through Contact form and which apply for workplace at Law Office.

Law Office is aware of the importance of protecting personal data and it approaches to the protection of personal data very seriously.

Law Office crated the Privacy Policy so the process of data processing would be accessible, transparent and understandable.

Data that we collect depend on the way in which the user is using the Website, and so the following data differs:

Data that we collect from the user voluntarily:

Every person that access the Website and sends inquiry through Contact form on the Website voluntarily can leave the following data:

  • Name and Surname,
  • Email,
  • Phone number,
  • Company name,
  • Information that the user chooses to share with the Law Office through Contact form,
  • Data that the user chooses to share with the Law Office for the purpose of eventual employment.

Every person which contacts the Law Office through the Contact form, by sending a inquiry to email address igorrako@rakolaw.com or by making a phone call, upon making a contact, may allow the Law Office access to additional information of a specific person, such as address, business address, employer name , the profession, the content of documentation and other attachments provided by a particular person, as well as any other information that a particular person chooses to share with the Law Office.

If a person contacts the Law Office for the purpose of employment (such as internship), he/she should submit a CV and a letter of motivation.

Law Office will obtain, from the person that is called for an interview for the purpose of employment, additional data about particular person during the interview and in later stages of employment process.

Law Office in the case of an engagement, may ask the particular person to provide, in addition to the abovementioned, additional information and personal data necessary for the provision of legal services, clearly stating the purpose of processing the particular data.

Personal data that we collect automatically:

When processing data based on the legitimate interest of the Law Office, we take care to process it in a way that does not endanger the rights and freedoms of users. When processing data from a legitimate interest, the Law Office takes into account the balance between the Law Office’s personal interests and the user’s privacy rights.

Processing of data based on the consent of the person to which the data relates  implies that the user can withdraw the consent at any time.

How data is used

We process user data on the express consent of the user and in accordance with other reasons that are permissible by law.

User data will not be stored and used for any purpose other than that for which it was originally collected.

Law Office guarantees that it will not misuse, sell or pass on to third parties any of user’s data.

Members of our team are bound by the obligation of keep the trade secrets, and also all legal measures have been taken to prevent the disclosure information, except for the purposes for which information were collected.

Time period for keeping data

Law Office, in its capacity as Handler, keeps the data for the period necessary for the accomplishment of the purpose for which data was collected, i.e. during the period of the user’s consent.

In case that the Contract on representation or Contract on providing Lawyer’s services is not concluded, user’s data will be deleted without delay.

Data submitted to the Law Office for possible employment, after the selection process is completed, will be stored for a period of one (1) year starting from the day of submitting the CV, for the purpose of re-contacting a specific person for future competition. Law Office deletes the user’s data after the expiry of the specified period.

Data sharing

Law Office doesn’t share user’s data with third parties except if:

  • it possess user’s consent,
  • there is legal obligation to share user’s data with, for example, government bodies (then there is no need for user’s consent) and
  • it is necessary to share user’s data for the purpose of providing quality legal services, when for example it is necessary to have consultations with legal specialist from specific fields, experts and expet witness.

User’s rights

The user, as a person whose data we process in accordance with applicable legislation, has the following rights:

  • the right of access,
  • the right to withdraw the consent,
  • the right to correction and amendment,
  • the right to delete data,
  • the right to object,
  • the right to restrict processing,
  • the right to transfer data
  • the right to submit complaint to Commissioner for information of public importance and personal data protection.

Law Office advises the user that the use of the right to withdraw the consent doesn’t affect the admissibility of data processing on the basis of consent in the period before the revocation of consent.

When addressing the Law Office it is necessary for the user to leave name and surname, address, email and phone number, and the Handler reserves the right to request additional information for the purpose of verifying identity of the user.

Competent supervisory authority for Rako Law Office is Commissioner for information of public importance and personal data protection, Belgrade, 15 Bulevar Kralja Aleksandra St, email: office@poverenik.rs and Belgrade Law Chamber, 13 Dečanska St, email: office@akb.org.rs.

Security

Rako Law Office has taken all organizational, technical, physical and administrative measures to protect all data it collects and processes, from all forms of abuse and theft.

In case that in addition to the measures taken, the data security of the user is compromised and if this could result in negative consequences for the user’s privacy, the Law Office will immediately notify the user and the relevant public authorities when necessary in accordance with the applicable legal regulations of the Republic of Serbia.

Changes

Law Office reserves the right to change or modify current Privacy Policy of the Website.

Users will be notified that the Privacy Policy is changed or modified through the Website or or via email, if provided by user.

Law Office will also request the user’s consent in case of material changes to the Privacy Policy, if it is necessary in accordance with the applicable legal regulations.

If user doesn’t accept changes of the Privacy Policy, Law Office kindly asks user to stop using the Website.

Privacy Policy was adopted on 14th of April 2020 and will enter into force on the day of its publication.
