Media Law Attorney

Media Law

Law Office Rako provides legal services and consulting in the field of media law, covering the increasingly common challenges arising from the development of modern media, online portals, and social networks. Media law in Serbia is at the intersection of several legal fields, including obligations law, intellectual property law, and personality rights.

Protection of Privacy, Honor, and Reputation

Special attention is given to cases of unauthorized publication of information in print and electronic media, where the right to privacy, the right to honor and reputation, and the right to dignity are often violated. Whether it involves a newspaper article, a web portal, or a TV report, the affected individual has the right to legal protection, including a request for publishing a response or correction of inaccurate information.

Copyright and Advertising

We also provide support in protecting copyright and related rights in cases of unauthorized use of copyrighted works (texts, photos, video materials, etc.) in the media space. As part of our legal consulting, we offer assistance regarding advertising regulations, content broadcasting on television and radio, as well as regulations related to electronic media.

Social Networks and Violation of Rights

Although social networks are not legally classified as traditional media, posts on these platforms can also serve as grounds for violations of personality rights. Our office provides support to individuals whose rights have been violated on platforms such as Facebook, Instagram, X (formerly Twitter), YouTube, and others, with the possibility of initiating appropriate legal proceedings.

Frequently Asked Questions About Media Law

Below you can find answers to the most frequently asked questions related to media law, protection of personality rights, copyright protection, and the application of relevant laws in Serbia:

If a printed or electronic medium publishes an article containing false information that harms your honor or reputation, you have the right to file a lawsuit seeking compensation for non-pecuniary damage resulting from the violation of personality rights. At the same time, you may request the removal of the disputed information and the publication of the court’s decision. In addition to taking the matter to court, you can submit a request to the media outlet to publish a reply or a correction of the inaccurate information.

A request for the publication of a reply to published information must be submitted to the media outlet within 30 days from the date of publication. The reply must be clear and specific. If the media outlet refuses to publish the reply, it is possible to initiate legal proceedings for failure to publish the response.

If a media outlet has published false or incomplete information, you have the right to request a correction in the same outlet. A correction can be requested independently of a reply and serves as a legal mechanism for protecting the truth in the public sphere.

If your photograph has been published without consent—especially if it violates your privacy or constitutes a copyrighted work—you may initiate legal proceedings to protect your personality rights or copyright, and seek compensation for damages.

Posts on social media that violate privacy, dignity, honor, or reputation—such as insults, false statements, or unauthorized photographs—may constitute a violation of personality rights. Legal proceedings for compensation may be initiated against such content.

Photographs are considered copyrighted works, and their use requires the author’s permission. Unauthorized use of photographs in newspapers, online portals, or on social media may constitute copyright infringement, for which one can seek compensation and request a ban on further use.

The Law Office Rako provides expert assistance in preparing requests for the publication of replies to information, corrections of information, initiating civil proceedings for compensation due to violations of honor and reputation, as well as protecting copyright in cases of unauthorized publication of content in the media.
